A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO, CALIFORNIA, DECLARING ITS INTENTION TO ORDER IMPROVEMENTS FOR ASSESSMENT DISTRICT NOS. 75-1, 75-2, 76-1, 76-2, 83-2, and 2002-1 IN ACCORDANCE WITH THE LANDSCAPING AND LIGHTING ACT OF 1972.

              WHEREAS, the Landscaping and Lighting Act of 1972 requires that, each year, the City Council consider proposed assessments and hold a public hearing prior to adopting said assessments.

                NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chino as follows:

                Section 1.  The City Council intends to levy and collect assessments within Assessment District Nos. 75-1, 75-2, 76-1, 76-2, 83-2 and 2002-1 during fiscal year 2018-19.  The areas of land to be assessed are located in the City of Chino, County of San Bernardino.

                Section 2.  The improvements to be made in these assessment districts are generally described as follows: maintenance of all streetlights and common landscaping as identified in the Engineer's Report, with the replacement of landscaping as needed.

                Section 3.  In accordance with this Council's Resolution No. 2020-030 directing the filing of an annual report, the Engineer of Work has filed with the City Clerk the report required by the Landscaping and Lighting Act of 1972.  All interested persons are referred to that report for a full and detailed description of the improvements, the boundaries of the assessments upon assessable lots and parcels of land within the assessment district.

                Section 4.  On Tuesday, July 21, 2020, at 7:00 p.m., the City Council will conduct a public hearing on the question of the levy of the proposed assessment.  Said hearing will be held in the Council Chambers, 13220 Central Avenue, Chino, California.

        PROJECT DESCRIPTION: The Reserve at Chino Hills Apartment Complex Final Phase Project (Project) proposes developing the final phase of a multi-family apartment complex in Chino Hills. The applicant is requesting approval of a Site Plan Review to develop the remaining 42 units within the Reserve at Chino Hills, an existing apartment complex that was approved by the County of San Bernardino in 1987 and built in 1990. The project site that will encompass the last phase is located on a 2.77-acre sliver of vacant property adjacent to the existing apartment complex. The Project would include the following:

- 28 two-story townhouse apartment units

- 14 attached ground floor apartment units

- Total of 42 units

 -42 detached 2-car garages and 21 guest stalls.

The Project would also include two dog parks as additional amenities for residents within the complex. The proposed layout would connect to the existing complex and the design and architecture would be consistent with the newly remodeled complex. Vehicular access to the Project will be provided via three (3) existing full access driveways located on Village Drive that now serve as access to the existing development. The Project would be constructed in a single-phase beginning in 2021, with completion and occupancy expected in 2022.  

PROJECT LOCATION: The project site (APN 1025-451-07) is a 2.77-acre sliver of land located on Village Drive, adjacent to the existing Reserve at Chino Hills apartment complex.

The Chino City Council will hold a public hearing in the Council Chambers, 13220 Central Avenue, at their regular council meeting on June 16, 2020 at 7 p.m., to consider the adoption of Resolution Nos. 2020-025 and 2020-026. Both resolutions will respectively memorialize the Chino City Council approving a new freeway agreement and a new freeway maintenance agreement between the State of California, acting through Department of Transportation, and the City of Chino for the State Route 60/Central Avenue Improvement Project. Additionally, approval of both agreements would necessitate the closure of City of Chino streets near the point of its interception with the State Route 60 freeway, prompting a public hearing to be conducted pursuant to Sections 100.2 and 100.22 of the California Streets and Highways Code.

    Notice is hereby given that the City Council of the City of Chino will hold a public hearing on June 16, 2020 at 7:00 p.m.  Action will be taken on the 2020‑2025 Consolidated Plan, Analysis of Impediments to Fair Housing Choice, 2020-2021 One-Year Action Plan for the use of U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) funds.

    The One-Year Action Plan details the proposed uses of the FY 2020-2021 CDBG allocation of $561,770.         PROJECT DESCRIPTION: To consider  a proposal to amend Title 16 of the Chino Hills Municipal Code, Chapter 16.20 to repeal PD-14-153 – Western Hills and Chapter 16.10 Table 20-1(D-L); to amend Chapter 16.10 (Residential Districts) Table 20-1(C) by combining RS-1 through RS-8 PD Development Standards and adding RS-9 into the table; to amend Appendix E (Individual Lot Setback Information for Single-Family Zoning Districts) of the Chino Hills Municipal Code to add the single family residential lots formerly within the Western Hills PD; and to amend the City of Chino Hills Zoning Map to reflect the new residential land use categories to designations consistent with their respective General Plan Land Use Map designations.

PROJECT LOCATION: The project is located within the Western Hills community located on Highland Pass Road.

        NOTICE IS HEREBY FURTHER GIVEN Staff has determined that the adoption of the ordinance associated with proposed Municipal Code Amendment No. 20MCA02 and Zone Change No. 20ZC01 are exempt from the provisions of the California Environmental Quality Act (CEQA) because they establish rules and procedures to permit operation of existing facilities; consist only of minor revisions and clarifications to existing regulations and specification of procedures related thereto; and consist of actions taken to assure the maintenance, protection and enhancement of the environment. Consequently, the proposed amendment to the Municipal Code and Zone Change are categorically exempt from further CEQA review under Cal. Code Regs. Title 14, §§ 15060(c)(2), 15061(b)(3), and 15378. A RESOLUTION OF THE CITY OF CHINO HILLS, ACTING IN ITS CAPACITY AS THE GOVERNING BODY OF SPECIAL MAINTENANCE AREAS 1 AND 2, SETTING THE DATE, TIME AND PLACE FOR CONFIRMATION OF ANNUAL ASSESSMENTS FOR SPECIAL MAINTENANCE AREAS 1 AND 2.

WHEREAS, Chino Hills Special Maintenance Area 1, previously formed by the Board of Supervisors of the County of San Bernardino as County Service Area 70-CH, provides street sweeping services throughout Chino Hills; and

WHEREAS, Chino Hills Special Maintenance Area 2, previously formed by the Board of Supervisors of the County of San Bernardino as County Service Area 48-A, provides road maintenance services in the Sleepy Hollow area of Chino Hills; and

WHEREAS, on February 11, 2020, the City Council of the City of Chino Hills adopted Resolution No. 2020R-009 ordering an Engineer's Report for annual assessments for Special Maintenance Areas 1 and 2; and

 WHEREAS, the City Council has been informed that the Engineer's Report described in said Resolution setting forth the proposed annual assessments for fiscal year 2020/21 is on file with the City Clerk; and

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF CHINO HILLS DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:

SECTION 1.  That the public interest and convenience require, and it is the intention of the City Council, to levy and collect within Special Maintenance Areas 1 and 2, for the expenses necessary for the maintenance, repairs, replacement, utilities, care, supervision, and all other items necessary for proper maintenance and operation of the improvements shall be confirmed as a special service charge upon each lot or parcel of land lying within the maintenance areas in proportion to the estimated benefits received from the existing maintenance and improvements.

SECTION 2.  That the Engineer's Report for the proposed Special Maintenance Areas 1 and 2 annual assessments was filed with the City Clerk and submitted to the City Council this date.  The Engineer’s Report may be referred to for a full and detailed description of the improvements, the boundaries of the assessment district, and any zones therein and the proposed assessments upon assessable lots and parcels of land within the District.

SECTION 3.  That the proceedings for the confirmation of the aforesaid charges contained in the Annual Report for the maintenance areas shall be taken under and in accordance with the State of California Government Code Section 25214.1 and the County of San Bernardino Ordinance No. SD-91-11 incorporated by reference into the Chino Hills Municipal Code.

SECTION 4. That on June 23, 2020, at 7:00 p.m., the City Council will conduct a public hearing remotely through Zoom and broadcast live on the City's website, pursuant to Section 3 of Executive Order N-29-20, issued by Governor Newsom on

March 17, 2020, to give all interested persons an opportunity to hear and be heard on the proposed assessments to be levied on Special Maintenance Areas 1 and 2 for Fiscal Year 2020-21, as contained in the Engineer's Report on file in the City Clerk's Office.

SECTION 5.  That on June 23, 2020, 7:00 p.m., the City Council will confirm the proposed assessments to be levied on Special Maintenance Areas 1 and 2 for Fiscal Year 2020-21, as contained in the Engineer's Report on file in the City Clerk's Office.  The City Council shall consider all oral statements and written protests made or filed by any interested person and may increase or decrease the proposed assessments.

SECTION 6.  The City Clerk is hereby directed to give notice pursuant to Government Code Section 6066, as applicable.

SECTION 7.  The City Clerk shall certify as to the adoption of this Resolution.
